J. TRETTER AND SONS CONTRACTING, INC. POLICY STATEMENT: ALCOHOL/DRUG-FREE WORKPLACE

It is the policy of J. Tretter and Sons Contracting, Inc. to ensure that its employees do not: report for work in an impaired condition resulting from the use of alcohol or drugs; consume alcohol while on duty; or unlawfully possess or consume any drugs while on duty, on Company premises or at any work site location. Any employee who violates this policy is subject to disciplinary action. The specifics of the policy follow:

POLICY

1. Drugs shall not be kept or taken by any employee on Company premises, or shall employees be under the influence of drugs on Company premises, unless used as prescribed by a licensed physician.

2. Employees who are unable to perform their assigned duties in a safe and competent manner or whose health and safety is endangered as a result of the use of alcohol or a nonprescribed drug should not report for work: will not be allowed to stay at work, nor allowed to perform any work for the Company.

3. The unlawful manufacture, distribution, dispensing, possession or use of a controlled substance in the workplace is prohibited, and is in violation of this policy and procedure and will result in disciplinary action up to and including termination.

4. Each employee is required to inform his or her employer in writing within five days after he or she is charged with a violation of any federal or state criminal drug statute.

DEFINITIONS

1. A drug or controlled substance is any chemical substance, the possession of which without appropriate authority, such as a doctor’s prescription, is unlawful. Such drugs may seriously affect an employee’s work performance and may endanger the employee's health and safety if used improperly. Such drugs include, but are not limited to, heroin, marijuana, cocaine, PCP, and "crack". They also include "legal drugs" which are not prescribed by a licensed physician.

2. Alcohol is any liquid containing intoxicating agents.

3. Company premises shall include office parking lots, company vehicles, and any location where work is being performed.
